The FDA’s Office of Criminal Investigations has uncovered a massive fraud involving the Seroquel® brand of the drug. The investigation was led by a former Seroquel user, David M. Kesselheim, who was charged with fraud and conspiracy to commit fraud.
Kesselheim is an attorney and has been handling the cases related to Seroquel since 2003. He was the lead investigator in the fraud and conspiracy cases at the FDA. As part of the investigation, Kesselheim purchased a copy of a “generic” version of Seroquel® from a company called Novartis in 2007 and then sent it through a website called “the Generic Drug Store.” In the same website, Kesselheim sent a text message to the website of an online pharmacy called the Pharmacy Checker, where he had a prescription for Seroquel. Kesselheim also received text messages from the pharmacy that indicated that he had received a package from Novartis and would like to return it to the pharmacy.
The FDA has also indicted Kesselheim with a federal offense, and a state of extent. The case is being prosecuted by Assistant U. S. Attorney’s Michael H. Rosenblum. The case is being prosecuted by U. District Judge Robert J. Gartner.
